Terms of Agreement

  • Please note that you, as a user, by using the website available at chilioutdoors.com, declare that you know and accept the following general terms and conditions, drawn up on the basis of §§ 6:77–6:81 of the Hungarian Civil Code (Act V of 2013). Please, if you book a date for any Chili Outdoors programme, read our Terms and Conditions of Participation carefully, and only use our services if you agree with and accept every point of them.
    This document is concluded exclusively in electronic form. The contract governed by the following terms qualifies as a contract concluded between absent parties under the Civil Code.
  • Chili Outdoors is not a travel agency, but a business providing sports and leisure activities and renting out equipment. The prices do not include travel, accommodation, meals or insurance costs; participants arrange these individually. For our kayaking programmes we provide an experienced guide with local knowledge, as well as quality equipment that meets the regulations. The participation fee applies to the specific programmes we run, and entitles you to take part in the tours under the conditions of these rules. We are happy to help with information regarding accommodation and travel questions.
  • All rules serve the purpose of ensuring that you have a safe and enjoyable experience.

  • These terms of use (hereinafter: Rules) contain the conditions for using all services that can be accessed on the site operated by Chili Outdoors (hereinafter: Operator), available at https://chilioutdoors.com (hereinafter: Site).
  • For the purposes of these Rules, a User is a visitor to the Site, or a user of the services available here or of any element thereof. Accordingly, by starting to use any service, the User accepts these Rules.
  • The Site reserves the right to amend these Rules, and notifies the User of any amendment in the form of a notice on the Site. Following a published statement about an amendment of the Rules, by using any service the User acknowledges and accepts the amendment.
  • The Privacy Policy also forms part of these Rules, as does every further document related to the operation and services of the Site. Accordingly, these Rules and every associated document are binding on the User.
  • During the online purchase, the User accepts the terms of the contract for the Service, and thereby the provisions of this document, at the latest by pressing the “Pay” button. Upon conclusion of the contract, the User declares that they have become acquainted with the conditions set out in these Terms and Conditions of Participation and have accepted them as binding, and furthermore has consented to the handling of the data necessary to use the Service within the scope defined in the Terms and Conditions of Participation and its data-management rules.
  • The purpose of the Site's services is for users to purchase services by card payment or bank transfer.
  • The Operator reserves the right to modify or discontinue any content element of the Site, to modify its appearance, content and operation, and to display advertising, any content or its own services on the Site.
  • Chili Outdoors, as service provider (hereinafter: Provider; detailed company data and contact details can be found in the “Imprint” section), operates an online internet system (hereinafter: System) to facilitate the purchase of participation (hereinafter: Participation right) in Chili Outdoors programmes.
  • These General Terms and Conditions of Participation (hereinafter: T&C) define the conditions for using the Service relating to booking programmes between the Provider and the natural person using its internet system (hereinafter: Customer; together: the Contracting Parties), as well as the rights and obligations arising between the Parties.
  • A contract concluded by way of online purchase does not qualify as a written contract, and is therefore not accessible in archived form. The conclusion of the contract is evidenced by the electronically stored purchase data.
  • The agreement between the Parties is concluded in the language selected, and in the event of a dispute, in Hungarian. Due to the nature of the internet, the territorial scope of these T&C is not limited to the territory of Hungary.
  • The Provider informs the Customer, and the Customer expressly acknowledges, that the Provider is entitled to amend the T&C unilaterally.
  • The Provider reserves the right to reject the Customer's order in justified cases, in particular in the case of providing false or incomplete data, or any abuse of the System or the Participation right.
  • The Customer bears full responsibility for all purchases and other activities carried out via the https://www.chilioutdoors.com site.
  • The Customer undertakes to notify the Provider's customer service without delay in the event of any unauthorised use of their data or any other breach of security.
  • The Customer declares that their data has been provided truthfully in the System. The Provider excludes its liability for any damage arising from the provision of incorrect, erroneous or false data or email address during the purchase; however, it may claim compensation for any damage arising in this connection from the Customer.
  • The Provider is responsible for performance and for issuing the invoice in accordance with the data provided by the Customer. The Customer may check and modify their data at any time. The Provider is entitled to delete obviously incorrect or false data, and in case of doubt is entitled to verify the authenticity of the Customer.
  • The Customer consents to the Provider using the data they provided electronically in electronic form for the purpose of performing the contract. The Provider handles the Customer's data on the basis of the data subject's voluntary consent pursuant to Section 3(1) of Act LXIII of 1992 on the protection of personal data and the disclosure of data of public interest (Avtv.), and in accordance with the rules of Act CVIII of 2001 on certain issues of electronic commerce services and information society services. Should a legal dispute arise in connection with the Service, the data handling lasts for the duration of the dispute or until the claim becomes time-barred.
  • If the Customer subscribes to the Provider's newsletter, the Provider sends a newsletter at a frequency of its own choosing. The Customer may prohibit such use of the data at any time by unsubscribing. In the case of Customers subscribed to the Newsletter, the Provider is entitled to offer services in a personalised manner based on the presumed area of interest according to place of residence, previous purchases and other data provided.
  • The Provider acts with the greatest possible care in connection with the handling and storage of personal data. However, the Provider is not liable for any damage caused by unavoidable attacks that occur despite the greatest possible care.
  • Only adults, and young people who have reached the age of 14 accompanied by an adult, may participate in the programmes. The participation of children under the age of 14 requires prior consultation.
  • Confident swimming ability is mandatory for every participant, which the guide may even check.
  • The equipment provided must be used properly, in accordance with the prior instruction. Otherwise, any material damage that occurs is borne by the participant.
  • The participant must behave according to the guide's instructions during the programme.
  • Protecting nature is fundamental to us, so littering or otherwise harming nature is prohibited on our tours. It is also strictly forbidden to disturb or collect any living organisms.
  • We consider it important to ensure the peace of other visitors and local residents, so we do not find disturbing or endangering others acceptable.
  • Participating in the tours while intoxicated or under the influence is expressly dangerous, and is therefore not permitted.
  • Cardiovascular complaints, mental and psychological illnesses, dizziness and coordination disorders may constitute grounds for exclusion from the tours. If you have any questions, please consult us.
  • Failure to comply with the conditions of participation results in immediate exclusion. We are unable to provide financial compensation for exclusion from a tour.
  • Our programmes, by their nature, carry a certain amount of risk. Your guide does their best, with all their knowledge and intent, to minimise the risks. A basic condition of this is that every participant must follow the guide's guidance and instructions throughout the entire duration of the tour.
  • Personal responsibility is very important, because a kayak is an individually propelled watercraft, and handling it is your task. You take part in the tour at your own risk; Chili Outdoors and the guide cannot be held liable for personal injury or material damage.
  • Compensation for damage arising from the improper use of equipment provided by Chili Outdoors on the tours, and from the loss of equipment, is borne by the participant.
  • The prices are gross prices exempt from VAT.
  • The Provider is entitled to offer discounts from the announcement of the service until the day of the service.
  • The Provider may run prize games in which a discounted or free participation right can be won.
  • The Customer may transfer the purchased Participation right to another person.
  • The Customer declares that they will only transfer the Participation right to another person if the new participant has accepted the Provider's T&C.
  • The purchase price is settled by bank transfer or card payment.
  • In the event of force majeure occurring during the purchase, the Customer must notify the Provider without delay (hello@chilioutdoors.com). After 24 hours have elapsed, we are unable to remedy any payment complaint that is not due to a bank-technical error.
  • The Provider may refuse participation or oblige the Customer to pay an additional fee if their eligibility for a discount cannot be verified or does not exist.
  • Bank transfer
    Payment for the booking by bank transfer is made to the provider's bank account no. 10402207-86766855-53681015 held at K&H Bank Zrt. (BIC: OKHBHUHB, IBAN: HU15 10402207-86766855553681015). The verification of incoming transfers and, together with it, the confirmation of the booking takes place within 24 hours of the full amount of the service price arriving. If the online banking system is not operational, the verification of transfers and the sending of the confirmation may take place at a later time. An online purchase by transfer is only valid if the consideration for the service arrives by bank closing at the latest on the day of the event (or, if this falls on a public holiday or weekend, on the preceding banking day). Otherwise, we can only accept card payment.
  • Online card payment
    Online card payments are processed via the Barion system. Card details do not reach the merchant. The service provider, Barion Payment Zrt., is an institution supervised by the National Bank of Hungary, licence number: H-EN-I-1064/2013.
  • Registering for a free date of the selected programme, the Customer receives a payment link in the confirmation email, where they choose the bank transfer option.
  • In the case of bank transfer, the Customer settles the price of the programme they booked by a normal transfer to the bank account provided in the email.
  • In the transfer notice, they indicate their name, email address and booking number.
  • The Provider sends a confirmation to the email address provided.
  • Without confirmation, the purchase is invalid!
  • The Customer bears all liability for any damage arising from providing an incorrect email address.
  • The Provider sends the invoice for the purchase in electronic form, by email, to the email address provided.
  • Registering for a free date of the selected programme, the Customer receives a payment link in the confirmation email, where they choose the card payment option.
  • The Customer fills in the card payment form with their details. The bank confirmation of the transaction means the completion of the purchase.
  • Without confirmation, the purchase is invalid!
  • The Customer bears all liability for any damage arising from providing an incorrect email address.
  • The Provider assumes no responsibility for any errors that arise during the bank payment.
  • The Provider sends the invoice for the purchase in electronic form, by email, to the email address provided.
  • Barion is a service that processes electronic payments. With its help, it is possible to pay by card in our online shop, even without registration or from a prepaid balance.
  • Registration is not mandatory for card payment; it is enough to provide the card number, the expiry date and the CVC code found on the back, as well as a working email address. However, a pre-loaded Barion balance can also be used for payment, which can be topped up by transfer or cash deposit, or to which others can also send money. In this case, purchasing is also possible by providing an email address and password.
  • The purchase can be interrupted at any time without consequences before pressing the “Pay” button. After that, pursuant to Section 1 (4) b) of Government Decree 17/1999 (II.5.), the Customer is not entitled to the right of withdrawal from using the booking service. The Provider is unable to refund the value of the purchase.
  • If you would nonetheless like to take part in the paddling on another date, we can of course modify your booking according to the available free places.
  • Kayaking, as a form of nature outing and an outdoor sport, greatly depends on environmental factors due to its nature. The weather, water conditions and the physical and mental state of the participants affect whether the programme can be carried out.
  • The guide decides on whether the programme takes place; in this consideration, safety, protecting the equipment and complying with the legal framework are the main criteria.
  • The guide may decide, both before and during the programme, to change or suspend it under the above conditions.
  • If it is foreseeable before the start of the programme that the tour cannot be completed (flood, extreme weather), the guide may initiate the postponement of the programme.
  • The Customer acknowledges that, due to the nature of the internet, the continuous operation of the System may be interrupted even against the Provider's prior knowledge and intent. Accordingly, the Provider does not guarantee error-free and undisturbed operation of the Service and the associated website, or that access to the Service will be continuous or error-free.
  • The Provider is entitled to suspend the Service partially or entirely, without any prior information or notice, for the purpose of maintaining the Service or the associated website, or for other security considerations.
  • The Provider is only liable for damage caused by intentional or grossly negligent errors attributable to it. The extent of liability may not exceed the value of the purchase transaction.
  • The Customer acknowledges that the Provider is not responsible for any damage or abuse that arises during or as a result of payment by card.
  • The information and other documents available on the website are protected by copyright; the related rights belong to the Provider or the rights holders. The information and other materials available on the website may not be used, copied, distributed or made public by third parties in a manner contrary to the purpose of the website without the express prior written approval of the Provider or the rights holders.
  • The Provider acquires an unlimited and exclusive right of use over the comments (e.g. chat, blog), observations, suggestions and ideas communicated by the Customer in connection with the use of the website. The Provider becomes the exclusive owner of all such rights related to the observations and cannot be restricted in any way in their use. The Provider is entitled, without restriction, to utilise, use, publish, rework, delete and make public the User's observations without having to provide any consideration to the Customer for this.
  • During the programme, the Provider gives its prior consent to the use of the video, audio and image recordings made at the event by visitors for private purposes, including publication on the internet.
  • The publication of all images and audio material made at the programme in online or printed (newspapers, magazines, TV, radio) media, or their use as any kind of advertising material, is only permitted with the consent of the organisers!
  • The organisers reserve the right to refuse or withdraw this authorisation in justified cases.
  • The participants of the programme accept that image and/or audio material may be made of them during the programme, and that the organisers may use it for advertising purposes.
  • The Provider is entitled to engage subcontractors and data processors. It is liable for the subcontractors as if it had provided the service itself.
  • These General Terms and Conditions of Participation were drawn up in Hungarian; in their interpretation, the rules of Hungarian law are decisive.
  • In matters not regulated in these General Terms and Conditions of Participation, the relevant provisions of the Civil Code apply accordingly.
